Terms of Sale

These Terms of Sale apply to any order for a paid subscription (Starter, Pro or Elite) to the Elofoot service by a natural person consumer. Any subscription entails acceptance of the Terms of Sale, Terms of Service and Privacy Policy in their version in force at the date of the order.

The service is open for subscription to consumers residing in the European Union. Perform Code SAS reserves the right to restrict, suspend or block, at any time, access to payment and subscription from one or more countries, as well as to change the eligible geographic area, in particular for regulatory, tax, fraud-prevention or technical reasons, without this giving rise to any compensation.

The subscription is attached to the Customer's Elosports account and gives access to every Elosports application (Elofoot, Elodunk, Elof1 and Elopunch), whichever application it was purchased from.

The Elofoot service is published and marketed by Perform Code, a simplified joint-stock company with share capital of €1,050, with registered office at 216 rue Clémenceau, 59139 Wattignies (France), registered with the Lille Métropole Trade and Companies Register under number 942 543 943. Contact: [email protected] — +33 7 80 97 88 17. Hosting: Railway Corp. (United States, under Standard Contractual Clauses and Data Privacy Framework).

Elofoot provides a digital football match prediction service powered by artificial intelligence. Each subscription gives access to a monthly quota of consumable units: 1 quota = 1 prediction (match or team) or 1 question put to the AI assistant. The service is provided for informational purposes and constitutes neither a guaranteed tips service nor a betting aid.

A single subscription grants access to all Elosports applications (Elofoot, Elodunk, Elof1, Elopunch), at no additional cost. The monthly quota is shared across these applications: a prediction generated from any one of them draws on the same quota. Adding a new application changes neither the price, nor the term, nor the cancellation conditions of the current subscription.

The “one free Pro week” prize provides a personal promotion code valid for 24 hours and usable only by the winner's Stripe account. The code gives a 100% discount on the first weekly Pro billing period. Stripe may require a payment card.

Unless cancelled before the renewal date shown at checkout, the subscription then renews automatically each week at the weekly Pro price displayed by Stripe when activated. The user must accept the Terms of Sale before confirming the order. The prize is personal, non-transferable, non-refundable and cannot be exchanged for cash.

Prices in euros, all taxes included: Starter €4.99/month (20 quotas), Pro €14.99/month (100 quotas), Elite €24.99/month (250 quotas). Weekly offer: Pro €6.99/week (25 quotas), Elite €9.99/week (60 quotas). Payment is due on order and processed by Stripe — no banking data is stored on our side. Renewal is tacit at each due date unless cancelled beforehand. Any payment default leads to immediate suspension of access.

The monthly quotas associated with each plan may change to reflect infrastructure costs (LLM, hosting, data provider) and the evolution of the service. Any substantial modification (notably a decrease of the quota on your current plan) is notified by email at least 30 days before it takes effect, with the right to cancel free of charge during this notice period (see art. 12).

For consumers residing in the European Union, prices are inclusive of French VAT at 20%. As long as the annual €10,000 threshold for intra-EU distance sales is not exceeded, French VAT (20%) applies to all European Union consumers and is remitted to the French tax authority; beyond that threshold, the VAT in force in the consumer's member State of residence applies.

For consumers residing outside the European Union — in particular for passes paid with mobile money in local currency — the price shown before confirmation is the total price to pay, inclusive of any applicable taxes: we add no tax or fee on top of it. Any fees your bank or mobile operator may charge for the transaction remain your responsibility.

Mobile money payment. On the website, in certain countries (Côte d'Ivoire, Senegal, Burkina Faso, Benin, Cameroon, Congo, Gabon, DRC), payment can also be made with mobile money (Orange Money, MTN MoMo, Wave, Airtel Money, Moov) through our provider pawaPay. One-time prepaid passes are then offered: 7 days, 30 days, one-year Season Pass (Elite) or lifetime Elite. Prices are displayed and paid in local currency (CFA franc XOF or XAF, or US dollar in the DRC), all taxes included; the exact amount is shown before any validation. Payment is due upon ordering and is approved by you with your operator: Elofoot stores neither a wallet number nor a PIN code. By way of exception to the above, these passes are subject to NO tacit renewal and no later charge: access ends when the pass expires, unless a new pass is purchased, and a reminder email is sent before that date. A pass grants the same rights and quotas as the equivalent subscription (7 days: weekly quotas; 30 days: monthly quotas).

The “Lifetime” offer is a ONE-TIME purchase granting access to the Elite plan features FOR LIFE, with no subscription and no recurring charge. It is offered at €79 incl. VAT by bank card, or at the local-currency price shown before confirmation when paid with mobile money (see art. 4). Perform Code SAS may withdraw this offer at any time for new purchases, without affecting access already acquired.

“For life” refers to the operating lifetime of the Elofoot service by Perform Code SAS. Should the company cease activity or permanently discontinue the service, access ends without compensation or refund beyond what the law provides.

In accordance with Article L221-28(1) of the French Consumer Code, by requesting immediate performance of the digital service and ticking the corresponding box at payment, you acknowledge waiving your 14-day right of withdrawal as soon as the service is first used. No refund is due once the service has been performed.

The Lifetime offer CANNOT be combined with any promo code or other discount, and is not subject to any tacit renewal.

Orders proceed in four steps: (a) choice of plan and billing cadence; (b) login or account creation; (c) express acceptance of the Terms of Sale, Terms of Service and Privacy Policy, as well as the separate box 'I request immediate execution and waive my right of withdrawal once the service has been performed'; (d) validation of the Stripe payment. A summary email serves as acknowledgement of receipt and as an archived contract. For a mobile money payment, step (d) consists of validating the payment on the secure page of our provider pawaPay and then with your operator, the amount in local currency being shown before validation; the other steps are identical.

The service is made available immediately after payment validation. It is accessible 24/7, subject to maintenance operations, updates or failures of our technical providers (host, AI provider, data provider). Sports data (fixtures, statistics, standings, injuries, line-ups, match events) is provided by API-Sports.io (api-football.com). AI models used are supplied by third parties (Google Gemini, OpenAI or equivalents) and may evolve without notice. No 100% availability is guaranteed. In the event of prolonged unavailability of a critical sub-processor constituting a force majeure event (Article 1218 of the French Civil Code), Perform Code shall not be held liable for direct or indirect consequences of such unavailability.

In principle, you have 14 days to withdraw (article L221-18 of the French Consumer Code). By ticking the box provided at payment, you expressly request immediate execution of the service and accept that you will lose your right of withdrawal as soon as it has been fully performed (article L221-28, 1°).

From your first login to your account, or any action on the service (prediction, AI question, adding a favourite, viewing standings), the service is considered fully performed for the current period and you definitively lose your right of withdrawal.

If, and only if, you have never used the service since subscribing, you may exercise your right of withdrawal within 14 days by any unambiguous statement. For evidential reasons, we strongly recommend sending both:

• By registered letter with acknowledgement of receipt to: Perform Code — Withdrawal Service, 216 rue Clémenceau, 59139 Wattignies (France).
• Together with an email to [email protected] with subject 'Withdrawal — [account email] — [subscription date]'.

The statement must include: your first and last name, the email linked to the account, the subscription date, the chosen plan, and a sworn statement that you have not used the service since subscribing. A form template compliant with article R221-1 of the French Consumer Code is available on request at [email protected].

On receipt, we check the absence of use by cross-referencing our logs (within 7 working days). If non-use is confirmed, a full refund is made within 14 days to the original payment method. Failing that, the request is deemed unfounded and no refund can be granted.

The rules of this article (withdrawal period, request for immediate execution and loss of the right of withdrawal once the service has been performed) apply in the same way to prepaid passes paid with mobile money.

Any subscription is cancellable at any time from the personal space, in three clicks, free of charge, without penalty and without justification (French law no. 2022-1158 of 16 August 2022). Access remains active until the end of the paid period. No pro-rata refund is granted for a started period. Perform Code may terminate the account without notice in the event of serious breach (scraping, resale, payment fraud, identity theft). Prepaid passes paid with mobile money, which do not renew, require no cancellation: they end on their expiry date, with no pro-rata refund for a started period.

Before opening the cancellation flow, Perform Code SAS may offer a one-time 50% discount on the subscriber's next renewal. Accepting it causes no immediate charge, changes neither the plan nor billing interval, and does not extend any commitment period.

The discount applies once to the next invoice for the current subscription. Later renewals are billed at the applicable normal price unless the subscription is cancelled or otherwise validly changed before then. The offer is strictly limited to one use per account and cannot be transferred, refunded or exchanged for cash.

Declining the offer opens the Stripe portal so the subscriber can continue cancelling. Accepting the discount does not prevent a later cancellation under the usual terms.

Influencer commissions are reserved for accounts expressly activated by Perform Code SAS. The applicable commission rate is the one configured for the account or agreed in writing with Perform Code SAS. A commission is due when a referee attributed to the influencer's link subscribes to a paid plan and the corresponding payment is actually collected, whichever payment method is offered (bank card through Stripe, in-app purchase on the App Store or Google Play, or a prepaid pass paid with mobile money through pawaPay); for a payment in local currency, the commission is calculated on the euro price of the equivalent offer; mere sign-up, use of the free prediction or of a free account does not give rise to any commission. The commission is due only once, for the referee's first collected payment; renewals give rise to no additional commission. The commission is calculated by applying the rate to the excluding-tax (HT) price of the subscription, excluding VAT and any other tax. The number of referees and the total amount of commissions are not capped. Amounts displayed in the invite area are indicative until month-end verification; they may be corrected in the event of attribution error, refund, payment dispute, fraud, abuse or breach of these terms. Payment is made monthly, upon issuance by the influencer of a compliant invoice sent to [email protected] between the 1st and the 10th of the month following the relevant period; Perform Code SAS undertakes to settle the compliant invoice within fifteen (15) business days of its receipt. The influencer remains solely responsible for any tax, social security and reporting obligations linked to the amounts received.

Any complaint can be sent to [email protected]. Failing a satisfactory response, the Customer can freely refer the matter to a consumer mediator (details provided on request) or use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.

Personal data processing is governed by the Privacy Policy (https://www.elofoot.com/confidentialite). Under the GDPR and the French Data Protection Act, you have the rights of access, rectification, erasure, objection, restriction, portability and post-mortem directives, exercisable at [email protected].

All elements of the Elofoot service (interface, code, brand, content, predictions, databases) remain the exclusive property of Perform Code. The subscription grants a personal, non-exclusive and non-transferable right to use the service. Any reproduction, mass extraction (scraping, reverse engineering), resale or redistribution is prohibited.

Perform Code may modify these Terms of Sale, including the monthly quotas associated with each plan and the composition of features, to adapt to changes in the service or the legal framework. Any substantial change is notified by email at least 30 days before taking effect. During this period, you may cancel free of charge if you do not accept the new terms.

These Terms of Sale are governed by French law. In the event of a dispute and after failure of amicable resolution, the courts of the registered office of Perform Code have jurisdiction, subject to the protective rules applicable to consumers. The Consumer retains the option to bring proceedings, at their choice, before the court of the place where they resided at the conclusion of the contract.
